Federal environment law deemed unconstitutional in Alberta Court of Appeal ruling

CALGARY The Alberta Court of Appeal ruled that the federal government’s environment impact law was unconstitutional.

The Alberta government had called it a Trojan Horse. They challenged the Impact Assessment Act because of what they claimed was its overreach in provincial powers.

The act lists activities that can trigger an impact review. It allows Ottawa to examine the effects of new resource project on a variety of environmental and social issues, including climate.

Alberta had argued that the law could be used to expand federal oversight in areas of provincial jurisdiction.
