The Department of Forestry, Fisheries and the Environment (FRAP) has concluded the 2021/22 Fishing Rights Allocation Procedure (FRAP), in the nine (9) sectors of commercial fishing that were due for reallocation.

The Departments website will publish the General Publish Reasons for the Allocations (GPRs).www.dffe.gov.za) today, 28 February 2022.

Total of 2 473 applications were received. These applications were adjudicated in these sectors:

  • Hake Deep Sea Trawl
  • Hake Longline
  • South Coast Rock Lobster
  • Small Pelagic (Sardine & Anchovy);
  • Kwa-Zulu Natal CrustaceanTrawl
  • Demersal Shark Longline;
  • Squid;
  • Tuna Pole-Line and;
  • Traditional linefish

All applications were evaluated and evaluated by the Department before deciding whether to allocate commercial fishing rights. Each application was assessed for personal information. The documents also included information regarding the applicant’s past and current involvement in the fishing market, investment in it, performance and compliance history, transformation profile and contribution to the fishery. This information was used to determine who would be granted a fishing license.

Despite technical issues encountered with the Online Application System which necessitated two extensions periods to give Applicants more time to provide all relevant information to the system, the FRAP2021 Application Process is deemed substantially free, fair and transparent by an independent process observer.

All applicants and interested persons will be able, as of today, 28 Feb 2022, to download the General Published Reasons(GPRs) of the Delegated Authorities. Access the FRAP folder at the Departments website.

GPRs give an explanation of how scores were calculated for each fishing sector, per question, and how the quantum or effort methodology was developed and applied. The final decisions list on successful, unsuccessful, excluded, and/or reserved applicants.

Grant of Right Letters, Scoresheets, and Certificates of Acceptance will be electronically sent to applicants via registered email. These can also downloaded from the FRAP2021 website (https://www.frap2021.co.za/(link is external)). After receiving the Grant of Right Letter and Scoresheets, applicants and interested persons have 30 days to file appeals in writing to the Ministry of Forestry, Fisheries and the Environment. The prescribed Appeals Form should be submitted electronically online through the FRAP2021 site, before the closing date of 29/04/2022.

It is important that the exemptions were granted only to existing fishing operators in the fishing sector that was due for re-allocation. All fishermen currently fishing under this exemption are required to stop operations within 72 hours (by Thurday, 03/03/2022, 23h59), and return to port to have their catch weighed and landed in accordance to the relevant permit conditions. All levies must be paid within the stipulated time frames. Failure to comply with the terms would lead to legal action.

The 2021 FRAP rights holders who are successful must apply for their new Catch Permits.
