The following definitions are applicable to this chapter:
(a)Applicant refers to a public entity or its affiliates or a person or entity who undertakes a publicly works project and proposes a successor, heir, or assignee.
(b)Environmental leadership project, leadership project or project is a project that falls under the definition of Section 21065 and is one of the following.
(1) A residential, commercial, commercial, sports or cultural entertainment project that has been certified as Leadership in Energy and Environmental Design gold or higher by the United States Green Building Council and where
This standard achieves a 15 percent higher standard of transportation efficiency than comparable projects. These projects must be located at an infill site. If the project is located within a metropolitan plan organization, the infill project must be compatible with the general use designation and density, building intensities, and applicable policies for the project area in either a sustainability communities strategy, or an alternative strategy. The State Air Resources Board has accepted a metropolitan planner’s determination that the sustainable communities strategy, or the alternative strategy, would, if implemented to, achieve the greenhouse gas emission targets.
(2)A clean renewable energy
A project that generates electricity solely through wind or sun, but not by waste incineration and conversion.
(3)A clean energy manufacturing company that produces products, equipment, and components for renewable energy generation, efficiency, or the production of clean fuel vehicles.
(4) A clean energy transmission facility that upgrades existing transmission infrastructure in order to bring renewable energy from an off-shore wind project located within the County Humboldt.

(5)(A) A housing development project that meets all the following conditions:
(i) The housing development project is located at an infill site.
(iii)A housing development project located within a metropolitan planner organization that has a sustainable community strategy or alternative plan strategy in effect must be consistent with the general usage designation, density, and building intensity as specified in either a sustainability communities strategy (or alternative planning strategy) for the project. The State Air Resources Board has accepted a metropolitan planners determination under subparagraph (H), paragraph (2) of Section 65080, Government Code, that the sustainable community strategy or alternative planning strategies would,
If implemented, it will achieve the greenhouse gas emission targets.
(iii). The housing development project will require a minimum investment of fifteen millions dollars ($15,000,000), but less that one hundred million dollars ($100,000,000) in California after construction is complete.
(iv)(I).Except for subclause (II), at most 15 percent of a housing development project will be dedicated to housing that is affordable for lower income households as defined in Section 50079.5 (Health and Safety Code). The applicant or lead agency of a housing project that meets the requirements of this paragraph and has been certified by the governor shall notify the Office of Planning and Research of any housing units and affordable housing units.

(II)Notwithstanding Subclause (I), if an agency has adopted an inclusionary Zoning Ordinance that sets a minimum percentage of affordable housing within the jurisdiction where the housing project is located, which is higher than 15%, then the threshold for affordable Housing shall be the percentage specified in that inclusionary Zoning Ordinance.
(v)(I). Except for residential hotels as defined in Section 50519, no part of the housing project may be used for a short term rental unit or designated for hotel or motel, bed and Breakfast inn or other transient lodging purposes.
(II). No part of the housing project shall be used to manufacture or industrial.

(B) Housing development projects are, for the purposes of this paragraph:
(i) Residential units only.
(iii) Mixed-use developments consisting primarily of residential and nonresidential uses, with at least two-thirds designated for residential use.
(iii). Transitional housing or supportive housing.
(c)Infill Site has the same meaning that is set forth in Section 21611.3.
(d)Transportation efficiency is the number or fraction of vehicle trips made each day by employees, customers, or visitors to the residential, commercial or sports, cultural or entertainment project.
