Sussan Léy, Environment Minister wins appeal in landmark case regarding climate change

The Federal Court in Sydney today handed down a major climate change decision.

Sussan Ley, Environment Minister, has won her appeal against a landmark court decision that found she had a duty to protect Australian children from the effects of climate change.

The Full Court of the Federal Court of Appeal on Tuesday overturned the original judge’s decision that Ms Ley did have a duty of care.

The case was brought by eight teenagers trying to stop planning approval for Whitehaven Coal’s Vickery mine expansion in NSW.

They won a partial victory in July of last year, which Ms Ley appealed against.
