Chandigarh: The State Environment Impact Assessment Authority (SEIAA), Haryana has ordered the revocation of the environment clearance (EC), issued to the project proponent, after noticing major flaws in M/s Amravati Enclave’s construction activities at its housing project at National Highway-22, near Panchkula. Kulbhushan Goyal, a senior BJP leader and Panchkula Mayor, owns the project. The SEIAA found that the project developer has built two wings of a building on greenbelt in violation to the norms.
The environment clearance granted on March 25, 2010 and extended further on January 5, 2021 is hereby withdrawn with immediate effect. According to the SEIAA’s order, the project proponent will no longer be allowed to carry out any new activity, construction or expansion related to the project.
A subcommittee has been established by the SEIAA for environmental damage assessment and penalty. The committee was asked to submit its report within 60 calendar days. The committee includes Haryana’s state expert appraisal commission chairman Rajbir Singh Bondwal, SEC member, regional officials of Panchkula Haryana State Pollution Control Boards (HSPCB), M/s Perfect Enviro Solutions Pvt Ltd as the environment consultant. The project proponent will bear the cost of preparing environmental damage assessment reports.
This information was provided by the SEIAA the National Green Tribunal (NGT) which is currently hearing a case regarding alleged violations during construction of the housing development at Amravati Enclave.
The SEIAA informed NGT that the project lacked environment clearance (EC). This was almost three years. They also failed to meet the general conditions in the original EC dated March 25, 2010, which was dated March 24, 2017. The project proponent failed to provide any convincing evidence regarding construction done during the absence period. The project proponent appears to have chosen not to speak out about the construction of EWS Flats and the booth next to Cosmos as well as the two wings of Cineraria Block on the green belt. A revised building plan was also dated January 30, 2018. This act by the project proponent should be compared as construction was done without approval in terms of EIA notification. This act is a clear violation of the September 14, 2006 EIA notification submitted by the SEIAA in its report.
According to the SEIAA report, the authority considers the case to be ineligible for the extension of M/s Amravati Enclave NH-22 shopping mall, 1,080 flats, and plots at villages Bhagwanpur and Islampur, Chandimandir Kalka national highway, near Panchkula.
The SEIAA also stated that the project falls within 10 kilometers of Sukhna Wildlife Sanctuary, where construction activities are prohibited without permission. SEIAA also highlighted several flaws in the project of one of the most powerful political leaders in the district.
The matter is currently pending before NGT through Ramesh Malik’s application. Ramesh Malik is an advocate and resident in Amravati Enclave and has been pursuing this matter for a while. Grievance in this case is against the extension EC. The SEIAA was not competent to grant EC due to the general condition. This states that if there’s a wildlife sanctuary within 10kms, the project will need MoEF&CC approval. Two sanctuaries are located at 3.90km and 1.6km, respectively, according to the application.
